JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-10-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406,420,379 and 506/34 of the Indian Penal Code.

The prosecution case is that the informant's relative Devendra Rai persuaded him to purchase land from Sheoji Singh who claimed himself to be the power of attorney holder of the actual land owner. Consequently, under an agreement the informant paid to Sheoji Singh one lac rupees against the total consideration amount of rupees seventeen lacs twenty five thousand. Subsequently, neither the sale deed was executed nor money was returned when protest was made then the accused persons

Patna High Court Cr.Misc. No.41811 of 2015 (2) dt.12-10-2015 2/2 including the petitioner assaulted the informant and gave life threatening.

It is submitted by the learned counsel for the petitioner that for the occurrence of assault on 23.7.2013 the FIR has been registered on 29.3.2013. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the thrust of accusation against Sheoji Singh and co accused Devendra Rai being granted anticipatory bail vide Cr. Misc. No. 30808 of 2014, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Hajipur Sadar P.S. Case No. 135 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
