JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 07-04-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceeding. The petitioner seeks bail in connection with Turkauliya P.S. Case No. 674 of 2015 registered for the offences punishable under Sections 304(B), 34 of the Indian Penal Code. By order dated 05.03.2021, a report was called for regarding the status of Turkauliya P.S. Case No.674 of 2015. The report is at Flag 'R'.

Perused the report of learned Additional District and Sessions Judge-VIII, East Champaran, Motihari in which it is stated that in this case charge has been framed against the accused persons on 02.01.2021 and thereafter evidence of all the three non-official charge sheeted witnesses has already been

Patna High Court CR. MISC. No.38011 of 2020(4) dt.07-04-2021 2/2 recorded. Now the case is pending for the evidence of I.O. and two witnesses of the inquest report and Doctor. For their evidence, summons have been issued through Superintendent of Police, Motihari, East Champaran on 06.03.2021. In the facts and circumstances of the case, I am not inclined to enlarge the above named petitioner on bail. Accordingly, the prayer for bail of the above named petitioner in connection with Turkauliya P.S. Case No. 674 of 2015 pending in the court of learned C.J.M, Motihari, East Champaran is hereby rejected. However, the learned trial court is directed to conclude the trial within six months.
