JUSTICE SHIVAJI PANDEY ORAL ORDER 19-10-2016 Learned counsel for the petitioner is permitted to make necessary correction in paragraph No.1 of the application. Learned counsel for the petitioner submits that vide order dated 08.09.2016 passed in Criminal Miscellaneous No.17140 of 2016 bail was granted to the petitioner on condition that one of the bailors should be parents of the petitioner, but mother and father of the petitioner have died. In support of his submission, he has annexed the death certificates of mother and father of the petitioner.

Learned counsel for the petitioner further submits that the uncle of the petitioner namely, Bangali Sah, son of late Yoga Sah is ready to furnish the bail bond. A statement to this effect has been made in paragraph No.5 of this application. In such view of the matter, the order dated

Patna High Court Cr.Misc. No.44548 of 2016 (2) dt.19-10-2016 2/2 08.09.2016 passed in Criminal Miscellaneous No.17140 of 2016 is modified to the extent that the bailor of the petitioner would be his uncle namely, Bangali Sah, son of late Yoga Sah, resident of Pokhara Chawk, Narkatiyaganj, P.S.-Shikarpur, District-West Champaran.

It is clarified that this order is only confined to petitioner No.1-Raja Sah of Criminal Miscellaneous No.17140 of 2016 with respect to Shikarpur P.S. Case No.99 of 2016, registered for the offences under Section 341, 323, 307/34 of the Indian Penal Code, under sections 8 and 10 of the Protection of Children From Sexual Offences and under Section 27 of the Arms Act.

Accordingly, this modification application is disposed of.
