====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 14-09-2018 Heard learned counsel for petitioners and learned counsel for the State.

Petitioners, who are in custody, seek bail in connection with Kanti (Muzaffarpur) P.S. Case No. 94 of 2018 registered for the offences punishable under Sections 341, 447, 307, 504 and 506/34 of the Indian Penal Code and under Section 27 of Arms Act.

Informant has stated in her fardbeyan that on 02.03.2018 at about 03:00 P.M. when she was sitting at her door with family members she saw petitioners armed with fire arms came there on two motorcycles at the house of Shiv Chandra Bhagat and started abusing and firing and when informant

Patna High Court Cr.Misc. No.39869 of 2018(3) dt.14-09-2018 2/2 reached there and resisted them then Sanjay Sahni fired with pistol and injured her right leg and Sanoj Sahni fired at Raju Kumar and injured his leg and on raising alarm petitioners fled away.

It has been submitted on behalf of the petitioners that they are innocent. They have been falsely implicated in this case. Injury is simple in nature. Nothing has been recovered from the possession of the petitioners. They are in custody since 27.03.2018. There is case and counter case.

Considering the aforesaid fact and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Division Judicial Magistrate, (West) Muzaffarpur in connection with Kanti (Muzaffarpur) P.S. Case No. 94 of 2018 (G.R. No. 558 of 2018).
