JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-06-2019 Petitioner seeks bail in anticipation of his arrest in connection with Gogari (Poura) P.S. Case No. 117 of 2018 registered for the offences punishable under Sections 307/34, 353 of the Indian Penal Code and Section 27 of the Arms Act. FIR disclosed the allegation that accused persons, including the petitioner came and started firing while the informant, who happens to be Bataidar, was harvesting paddy in presence of Circle Inspector.

Submission of learned counsel for the petitioner is that there is land dispute between the parties and the whole allegation is false and concocted and he has falsely been implicated in this case.

Heard learned APP also.

In view of the fact that in presence of Circle Inspector

Patna High Court CR. MISC. No.39472 of 2019(2) dt.27-06-2019 2/2 firing was made by the petitioner and others, as such, I am not inclined to grant the privilege of anticipatory bail to the petitioner. However, if he surrenders and prays for regular bail, the same shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.

With the above observation, this application is dismissed.
