JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 143, 341, 323, 379, 354A, 504, 506 of the Indian Penal Code and 3/4 of The Prevention of Witch (Daain) Practices Act, 1999. The prosecution case is that the FIR named accused persons including the petitioners by abusing the informant entered into her courtyard and called her as a witch and also assaulted her when Manjur Devi and Chandan Kumar came to rescue then they were also assaulted by the accused persons. It is further alleged that the accused persons torn her clothes when petitioner no.5 Pravesh Paswan snatched silver and gold chain from the sister-in-

It is submitted by learned counsel for the petitioners that for petty dispute the accusation has been levelled. The accusation is omnibus and general. Moreover, statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Saharsa in connection with Salkhua P.S. Case No.140 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
