1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 191(2), 190, 126(2), 127(2), 115(2), 132, 262 and 352 of the B.N.S., 2023.
3. The learned counsel submits that the petitioner has antecedent of one case under the Excise Act and the informant alleges that one accused was apprehended when 1520 persons gathered and attacked the force has freed the apprehended accused, but police managed to apprehend Trilokinath Yadav along with the motorcycle who disclosed the name of the accused persons who was freed as petitioner.
4. The learned counsel for the petitioner submits

No.40523 of 2026(2) dt.02-07-2026 2/2 that petitioner has been falsely implicated in the instant case for the reason that he was earlier implicated in a case relating to excise, it is next submitted that one more FIR has been instituted by the Department of Excise, it is further submitted that confessional statement in police custody does not have any evidentiary value.
5. Learned A.P.P. for the State opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Trial Court within a period of six weeks, is directed to be released on anticipatory bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Trial Court in connection with Gidhaur P.S. Case No. 10 of 2026 subject to the conditions laid down under Section 482(2) of the B.N.S.S.
7. The application stands allowed.
