The petitioner seeks bail in Basantpur P.S. Case No. 129 of 2019, instituted for the offence under Section(s) 25(1-b)a, 26 and 35 of Arms Act.

Counsel for the petitioner submits that there is no recovery of any incriminating article from possession of the petitioner.

It is alleged in the written report that Police apprehended the Petitioner along with co-accused Vijay Sahani with Motorcycle. Firearm has been recovered from possession of co-accused Vijay Sahani. One Mobile Phone has been recovered from possession of the petitioner.

Counsel for the petitioner submits that Motorcycle

Patna High Court CR. MISC. No.40701 of 2019(2) dt.05-07-2019 2/2 is registered in the name of father of co-accused Vijay Sahani. He further submits that co-accused Vijay Sahani has already been granted bail by coordinate Bench of this Court vide order dated 25.6.2019 passed in Cr. Misc. 38762 of 2019. Petitioner is in custody since 21.4.2019.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Basantpur P.S. Case No. 129 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
