2. The petitioner is apprehending arrest in connection with Rahika P.S. Case No. 88 of 2024, dated 17.04.2024, lodged under Sections 356 & 379 of the Indian Penal Code.

3. As per the prosecution, FIR has been lodged against unknown accused persons with the allegation that three unidentified bike riders, armed with a gun and a knife, surrounded the informant's motorcycle and looted his motorcycle and purse.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel further submits that the petitioner is not named in the FIR, and his name has figured in this case solely on the basis of the

Counsel further submits that nothing incriminating has been recovered from the possession of the petitioner, and even if anything has been recovered, it was from the possession of the co-accused, not from the petitioner.

5. Counsel further submits that the petitioner has not been put through a Test Identification Parade (TIP) till date. Counsel also submits that there is only one criminal case pending against the petitioner, i.e., Rahika P.S. Case No. 91 of 2024, whereas the present case in which the petitioner is seeking bail is Rahika P.S. Case No. 88 of 2024. This indicates that prior to the present case, the petitioner had a clean criminal record with no case pending against him.

6. Learned APP for the State opposes the prayer for bail of the petitioner and submits that the criminal antecedent of the petitioner is not clean.

7. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the
