JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-09-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 3.3.2017 passed in Cr.Misc.No. 2926 of 2017 and petitioner has not been named in the FIR and he has been implicated because of the fact that from the Mobile, which has been seized from the petitioner, talk of ransom was made. Submission of learned counsel for the petitioner is that the mobile number does not tally with the mobile number mentioned in the FIR and except suspicion there is nothing against him and co-accused has been granted bail by a co-ordinate Bench of this Court vide order dated 5.12.2016 passed in Cr.Misc.No. 39472 of 2016 and moreover petitioner is in custody since 18.6.2016.

No.41476 of 2018 (4) dt.05-09-2018 2/2 Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Fast Track Court-II, West Champaran, Bettiah, in connection with Sessions Trial No. 617 of 2016, arising out of Narkatiyaganj Rail P.S.Case No. 21 of 2016, subject to the conditions that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and petitioner has to co-operate in disposal of trial and appear before the trial court as and when required, otherwise his bail bond shall be cancelled.
