The petitioner, who is in custody, seeks bail in connection with Kankarbagh P.S. Case No. 315 of 2018 registered for the offence punishable under Sections 304(B), 34 of the Indian Penal Code.

Allegation against petitioner is that she used to torture the deceased for demand of dowry and due to nonfulfillment of demand of dowry killed the deceased. It has been submitted on behalf of the petitioner that the alleged demand of dowry which led to the killing of deceased has been made against the entire family members. There is no specific allegation against the petitioner. It has been

Patna High Court Cr.Misc. No.41619 of 2018(3) dt.30-08-2018 2/2 further submitted that petitioner was not present in the house when the occurrence took place. She is old lady. Similarly situated co-accused, namely, Nand Kishore Prasad has been granted bail by a Co-ordinate Bench of this Court vide order dated 01.08.2018 passed in Cr. Misc. No. 43880 of 2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna, in connection with Kankarbagh P.S. Case No. 315 of 2018.
