JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-08-2023 The present writ petition has been filed seeking the following relief:- "1.(i) For setting aside order dated 12.04.2023 passed in Encroachment Case No.01/2016-17 by Circle Officer, Harsidhi Circle Office, East Champaran whereby and whereunder petitioner was directed to vacate the encroachment from land in question which is appears from Notice dated 12.04.2023 (Annexure-1) although petitioner is not able to get order dated 12.04.2023 from office of Circle officer, Harsidhi, East Champaran, is further it is stated that petitioner seeks liberty to produce the order

Patna High Court CWJC No.9201 of 2023(4) dt.21-08-2023 2/2 dated 12.04.2023 after getting aforesaid order. (ii) For setting aside Notice dated 12.04.2023 dated was issued under signature of Circle officer, Harsidhi, East Champaran whereby and whereunder petitioner was directed to vacate encroachment from land in question by 28.04.2023."

After some arguments, the learned counsel for the petitioners seeks liberty on behalf of the petitioners to challenge the final order dated 12.04.2023, passed by the Circle OfficerHarsidhi, District-East Champaran, in connection with Encroachment Case No.1 of 2016-17, by filing appropriate Appeal. Liberty so sought is granted.
