====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 09-07-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. In the present case, the petitioner seeks bail in connection with Bihariganj P.S. Case No. 434 of 2024, registered for the offences under Sections 103(1), 3(5) of the BNS and Section 27 of the Arms Act.
3. As per the prosecution case, the father of the informant was shot dead by the coaccused persons and the name of the petitioner transpired during investigation for also being involved in the said occurrence.
4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. The occurrence took place on 30.12.2024 but the petitioner was in judicial custody in
Patna High Court CR. MISC. No.41617 of 2025(2) dt.09-07-2025 2/3 connection with Gwalpara P.S. Case No. 110 of 2024 since 28.12.2024 and release order was issued on 03.01.2025 so there could be no involvement of the petitioner on 30.12.2024 in the commission of murder of the father of the informant. Learned counsel further submits that the petitioner was named in this case merely on suspicion as one of the coaccused Sulendra Mahto stated in his confessional statement that the petitioner was also knowing about the said occurrence. But the petitioner had no knowledge about the alleged occurrence and has been falsely implicated in this case due to ill motive. The petitioner is having antecedent of four cases and he is on bail in all such cases. The petitioner is in custody since 29.03.2025 and charge sheet has been submitted.
5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the vague and doubtful nature of allegation against the petitioner and also considering his period of custody and submission of charge sheet, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the
Patna High Court CR. MISC. No.41617 of 2025(2) dt.09-07-2025 3/3 satisfaction of learned S.D.J.M., Udakishunganj, Madhepura/concerned court, in connection with Bihariganj P.S. Case No. 434 of 2024, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions: (i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
