The petitioners seek bail in Raxaul P.S. Case No. 18/2018, instituted for the offence under Section 394 of the Indian Penal Code.

Learned counsel for the petitioners has submitted that petitioners are in custody since 01.02.2018. They are not named in the written report. There is no recovery of looted articles from their possession. No T.I.P. has been held in this case. It is further submitted that police had arrested petitioner no. 2 from his house on confessional statement of co-accused and thereafter recorded

Patna High Court Cr.Misc. No.41655 of 2018 (3) dt.25-09-2018 2/2 the confessional statement of Petitioner no.2, who has taken the name of Petitioner no. 1 in his confessional statement. On the basis of confessional statement of petitioner no. 2, petitioner no. 1 has been arrested.

Considering the aforesaid fact and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Raxaul at Motihari, East Champaran in connection with Raxaul P.S.
