JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-11-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Again, I am not inclined to release the petitioner on bail taking note of the allegation leveled against him as well as injuries found on the person of the deceased and, accordingly, prayer for bail of the petitioner in connection with Session trail no. 395 of 2016 arising out of Bettiah Town P.S.Case No. 801 of 2015, pending in the court of Additional Session Judge-II, West Champaran at Bettiah stands rejected.
However, it would appear from perusal of the report dated 15.09.2017 sent by the learned Additions Sessions Judge 1st cum Special Judge, Bettiah, West Champaran that charge against
Patna High Court Cr.Misc. No.37822 of 2017 (5) dt.01-11-2017 2/2 the petitioner was framed on 4.01.2017 and up till now only three prosecution witnesses could be examined. Petitioner is in jail custody since 23.12.2015 but up till now his trail could not be concluded. Therefore, in the aforesaid circumstance, trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably, within six months from the date of receipt/ production of a copy of this order, failing which petitioner may renew his prayer for bail before the learned trail court itself.
