The petitioner apprehends his arrest in connection with Laheri P.S. Case No.100 of 2008 registered under Sections 406, 419 and 420/34 of the Indian Penal Code.

The accusation is that the petitioner asked the complainant/informant Ramnandan Prasad to get manage the job of his son Dharmveer Kumar saying that his brother-in-law Manik Chand Chaudhary is Head Clerk in the Bank and he got managed some persons employed, whereupon the complainant/informant approached the petitioner to talk to Manik Chand Chaudhary and after selling the land, paid Rs.1,00,000/- to Manik Chand Chaudhary, in presence of the petitioner, to get manage the job of his son but neither the job was provided to the son of the complainant/informant

Patna High Court CR. MISC. No.43275 of 2019(3) dt.20-08-2019 2/2 nor the money was returned to the complainant/informant. Learned counsel for the petitioner submits that on the basis of the complaint petition of the complainant/informant, the present F.I.R. was instituted against the petitioner and Manik Chand Chaudhary. On investigation, while the charge-sheet was submitted against Manik Chand Chaudhary, the brother-in-law of the petitioner, by the police but the final form was submitted against the petitioner. In spite of that the learned court below took the cognizance of the offence under Section 406 against the petitioner. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda, in connection with Laheri P.S. Case No.100 of 2008, subject to the conditions laid down under Section 438(2) Cr.P.C.
