The petitioner, who is in custody, seeks bail in connection with Ekchari P.S. Case No. 03 of 2018 registered for the offence punishable under Sections 302, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act. Allegation against the petitioner is of order giver. It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this case. Petitioner is only order giver and no overt act has been alleged against him. Petitioner has no criminal antecedent and he is in custody since 23.02.2018.

Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.41582 of 2018(3) dt.05-09-2018 2/2 the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Ekchari P.S. Case No. 03 of 2018.
