JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 385, 387 of the Indian Penal Code and Sections 25(1-B)A, 26 of the Arms Act. One loaded katta and thirteen cartridges are said to have been recovered from conscious possession of the petitioner and earlier, his prayer for bail was rejected by this court vide order dated 22.06.2016 passed in Cr. Misc. No. 25807 of 2016 but submission on behalf of the petitioner is that petitioner does not have any criminal antecedent and is languishing in jail custody since 02.04.2016.

Considering the period of detention of the petitioner

Patna High Court Cr.Misc. No.48639 of 2016 (2) dt.16-11-2016 2/2 in jail custody as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Arwal in connection with Kurtha P.S.
