19-08-2017 Heard Sri Swapnil Kumar Singh, learned counsel for the petitioner and Sri Shailendra Kumar-1, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody since 10-07-2017 in Kharik P.S. Case No. 144 of 2017 registered for offence under Sections 30(A)/38(i) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail. By way of referring to statement made in paragraph - 3 of the petition, it was submitted by learned counsel for the petitioner and petitioner is having clean antecedent and an elderly person aged about 70 years has been made accused on allegation of carrying about 6 litres of country made liquor, kept in number of pouches, in a bag.

Considering the nature of accusation, clean antecedent

Patna High Court Cr.Misc. No.39630 of 2017 (2) dt.19-08-2017 2/2 as well as period of custody, let the petitioner namely Shiv Mandal be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Court, Excise, Bhagalpur in connection with Kharik P.S.
