The petitioner who is in custody since 04.03.2019 has filed the instant application for grant of bail in connection with Alamganj P.S. Case No. 164 of 2019 registered for the offence punishable under sections 394 and 411 of the Indian Penal Code and sections 25(1-b) a, 26 and 35 of the Arms Act. As per the allegation in the FIR, while the informant along with his family members were returning home, three accused persons stopped them and on the point of pistol snatched the articles mentioned in the FIR. Thereafter, it is stated that information was given to the police immediately and the accused persons including this petitioner and one Saurabh Sagar were arrested.

No.38025 of 2019(3) dt.11-09-2019 2/2 It is submitted by learned counsel for the petitioner that the case of the petitioner stands on a similar footing to that of co-accused Saurabh Sagar who has been enlarged on bail by order dated 08.07.2019 passed in Cr. Misc. No. 41793 of 2019. Further this petitioner has no criminal antecedent and is in custody since 04.03.2019.

The application for bail has been opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including grant of bail to co-accused, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Patnacity, Patna in connection with Alamganj P.S. Case No. 164 of 2019 (Partha Sarthy, J) Prakash/- U
