The petitioner seeks bail in a case registered for offences punishable under Sections 420/120(B) of the Indian Penal Code and Sections 30(A)/38/41 of the Bihar Prohibition and Excise Act, 2016.
It is contended that there is no recovery from the conscious possession of the petitioner though huge quantity of foreign liquor was recovered from the different vehicle and room of PACS. It is contended that the petitioner belongs to some other village and one co-accused, namely, Ramakant Prasad @ Ramakant Singh has already been granted anticipatory bail by a co-ordinate Bench of this Court vide order
Patna High Court Cr.Misc. No.33682 of 2017() dt.20-07-2017 2/2 dated 13.07.2017 passed in Criminal Miscellaneous No.28342 of 2017. Petitioner claims his antecedent to be clean and he is in custody since 22.05.2017.
Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of 6th Additional District and Sessions Judge-cumSpl. Judge, Excise, Nalanda at Biharsharif in connection with Chandi P.S. Case No.151 of 2017.
Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bond.
