JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-09-2024 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel appearing on behalf of complainant/opposite party no. 2.

2. The petitioner, husband of the opposite party no. 2, apprehends his arrest in a complaint case punishable for the offence under Section 498A of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

3. At the outset, learned counsel for the parties submit that dispute in between the parties has been resolved in the Court below and both parties have decided to dissolve the marriage.

4. In the light of above submission made on behalf of

Patna High Court CR. MISC. No.46762 of 2024(3) dt.19-09-2024 2/2 the parties, the prayer for anticipatory bail of petitioner is allowed.

5. Accordingly, in the event of arrest or surrender within a period of eight weeks from today, let this petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Gopalganj in connection with Complaint Case No. 766 of 2023, subject to the conditions, as laid down under Section 438(2) of the Code of Criminal Procedure.
