The petitioner seeks bail in Barauni P.S. Case No. 92 of 2018, instituted for the offence under Section(s) 302 and 201/34 of Indian Penal Code.

In the written report it is alleged that informant who is Chowkidar got information that one dead body of unknown person kept in a sack was flowing in the Pond. The informant went to the place of occurrence. The dead body kept in sack was taken out from the pond with the help of villagers which was tied with the big stone. The informant raised suspicion against some unknown persons that they might have killed him. The dead body was decomposed. Therefore, the same could not be identified.

Counsel for the petitioner submits that petitioner is in custody since 1.9.2018. The name of petitioner has come during investigation on the basis of disclosure made by spy as mentioned in

Patna High Court CR. MISC. No.39482 of 2019(2) dt.01-07-2019 2/2 paragraphs-34 and 35 of the case diary.

Petitioner is in custody since 1.9.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Barauni P.S. Case No. 92 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
