JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-10-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,504,379,509 and 506/34 of the Indian Penal Code.

The prosecution case is that the petitioner stopped scooty of the informant, assaulted him and his nephew by means of iron rod and snatched the chain of the informant. It is further alleged that the accused persons took away the gold ear ring of the informant's mother.

It is submitted by the learned counsel for the petitioner that the petitioner at earlier point of time registered Piri Bazar P.S. Case No. 29 of 2015 against the informant. Statement has been made in paragraph 3 of the petition that the petitioner has no

Patna High Court Cr.Misc. No.39956 of 2015 (2) dt.05-10-2015 2/2 criminal antecedent. More over, there is nothing on record to suggest that any injury was caused to the informant. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Lakhisarai in connection with Piri Bazar P.S. Case No.30 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
