29-11-2021 Heard learned counsel for the parties.

Petitioners pray for grant of bail in Beur P.S. Case No. 196 of 2021 (G.R. No. 3744 of 2021) registered for the offence under Sections 25(1-b)a & 35 of the Arms Act. As per the prosecution case, from the rented house of petitioner no. 1, one .315 bore Musket was recovered from a box and petitioners were arrested on spot.

It is submitted on behalf of petitioners that nothing has been recovered from the conscious possession of petitioner no.1 and recovery has been made from the house of petitioner no. 1, which was taken on rent, whereas, there is no such recovery either from possession or premises of petitioner no. 2. Petitioners are in custody since 21.04.2021.

Patna High Court CR. MISC. No.51063 of 2021(2) dt.29-11-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioners is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Patna in connection with Beur P.S.
