2. The petitioner seeks bail in connection with Sakri P.S. Case No. 37 of 2025 registered for the offence punishable under Sections 8, 21(C) and 22(C) of the N.D.P.S. Act.
3. As per the prosecution case, FIR has been lodged against the sole petitioner. Total recovery of 27.5 litres of liquid syrup has been made which is the subject matter of the present case.
4. The petitioner is in custody since 03.06.2025.
5. The recovery is from the co-accused Bharat Shah and not the petitioner.
6. Considering the fact that the recovery is from the co-accused and not the petitioner and the period of custody,
Patna High Court CR. MISC. No.40919 of 2025(3) dt.10-09-2025 2/2 this application is allowed.
7. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Principal Sessions Judge, Madhubani/ concerned Court in connection with Sakri P.S. Case No. 37 of 2025, subject to the condition that both the bailors should be the close relative of the petitioner.
8. The petitioner will also mark attendance in Sakri Police Station, District- Madhubani on every Sunday of the month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) P. Kumar U T
