The petitioner apprehends his arrest in connection with Naubatpur P.S. Case No. 72 of 2015, registered under Sections 302 and 392 of the Indian Penal Code and Section 27 of the Arms Act, pending in the court A.C.J.M.-II. Danapur, Patna.

The accusation is that informant being the Khalasi of Pickup van along with driver, Haribans Rai, proceeded from Naubatpur after loading straw and when he reached near Naubatpur canal then four miscreants snatched Rs.4000/- from the pocket of driver Haribans Rai and two mobile phones. When driver, Haribans Rai made protest then miscreants opened fire,

Patna High Court CR. MISC. No.39745 of 2019(2) dt.28-06-2019 2/2 which hit the driver, Haribans Rai. The four miscreants was aged about 30 years.

Learned counsel for the petitioner submits petitioner is not named in the F.I.R. but in course of investigation, his name has surfaced in the confessional statement of co-accused, Nandan Kumar, who confessed his guilt detailing the name of this petitioner having hand in the present crime. Further submission is that Nandan Kumar has already been allowed privilege of bail by a bench of this Court vide order dated 16.10.2015 passed in Criminal Misc. No. 47253 of 2015.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
