2. The petitioner apprehends arrest in connection with Naugachia P.S. Case No. 278 of 2022 instituted under Sections 420 and 406 of the Indian Penal Code.

3. As per the prosecution case, the allegation against the petitioner is that informant had given Rs. 40,000 for depositing the same in the bank account by the petitioner but only 20,000 has been deposited.

4. Learned counsel for the petitioner submits that petitioner is a loan recovery agent of Punjab National Bank and he also holds the post of Field Officer for Punjab National Bank. Learned counsel for the petitioner further submits that petitioner

Patna High Court CR. MISC. No.43047 of 2023(2) dt.04-08-2023 2/2 has falsely been implicated in this case. The allegation against the petitioner is general and omnibus in nature. Learned counsel for the petitioner also submits that petitioner has not been given any date and time for depositing the said amount. Petitioner has no criminal antecedent.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount to each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Naugachia, DistrictBhagalpur in connection with Naugachia P.S. Case No. 278 of 2022, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
