Petitioner seeks bail in Hajipur Town P.S. Case No.166 of 2018 instituted for the offence under Section(s) 394 Indian Penal Code and Section 27 of the Arms Act. It is submitted that First Information Report is against unknown. There is no recovery of any incriminating article from his possession. He has been made accused in this case on the basis of alleged confession of the petitioner recorded by the police with regard to Sarai P.S. Case No.50 of 2018 in which petitioner was arrested on 31.03.2018. The petitioner is in custody in this case since 05.05.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner,

Patna High Court Cr.Misc. No.42181 of 2018 (3) dt.24-09-2018 2/2 above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Hajipur Town P.S.
