JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-09-2021 Heard Mr. Satish Chandra Mishra, the learned Advocate for the petitioners and the learned APP for the State. The learned Advocate for the petitioners seeks permission to withdraw the application with respect to petitioner no.3, who has been arrested during the course of pendency of this application.

The application with respect to petitioner no.3 is dismissed as having become infructuous.

The petitioner nos.1 and 2 who are co-villagers of the husband of the deceased seek bail in anticipation of their arrest in connection with Chandan P. S. Case No.19 of 2020, instituted for the offences under Sections 304(B), 201/ 34 of the Indian Penal Code.

The petitioner nos.1 and 2 have not been named in the

Patna High Court CR. MISC. No.3682 of 2021(2) dt.09-09-2021 2/2 F.I.R. but their complicity has transpired only in the supervision note of the police officer. The mother-in-law, two brothers-inlaw and nephew of the deceased have been granted anticipatory bail by a Bench of this Court in Cr. Misc. No.5145 of 2021 vide order dated 23.06.2021. So far as the petitioner nos.1 and 2 are concerned, their implication in this case is absolutely without any basis and only on wild guess.

The husband of the deceased is in custody.

Regard being had to the facts afore-stated, the petitioner nos.1 and 2, above-named, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Banka in connection with Chandan P. S. Case No.19 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
