The petitioner seeks bail in anticipation of his arrest in connection with Bidupur P.S. Case No. 345 of 2019 dated 03.09.2019 instituted for the offences under Sections 363 and 366 of the Indian Penal Code. The daughter of the informant is alleged to have been abducted.

Though the petitioner has been named in the FIR but after the recovery of the victim girl, she has given her statement under Section 164 Cr.P.C. in which she has not named the petitioner. In fact, the victim has stated that she has voluntarily married one Mithun Kumar.

He has been made accused in this case only because of the dispute between him and the informant with respect to a passage.

The victim is a major. Some of the other accused persons of this case have been granted anticipatory bail by a Bench of this Court.

Considering the aforestated facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 345 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.
