2. The petitioner seeks regular bail in connection with Kotwali (Tilka Manjhi) P.S. Case No. 320/2023, registered for the offence punishable under Sections 279, 337, 338 of the Indian Penal Code and under sections 25(1) (b) a 26(1)/35 of the Arms Act.

3. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. Petitioner has no criminal antecedent. Petitioner is in custody since 10.04.2023.

4. Learned APP has vehemently opposed the prayer

Patna High Court CR. MISC. No.42613 of 2023(2) dt.14-07-2023 2/2 for bail.

5. Considering the nature of allegation and period of custody, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur, in connection with Kotwali (Tilka Manjhi) P.S.
