The petitioner seeks bail in Mokama P. S. Case No. 135 of 2018 instituted for the offence under Section(s) 341,323, 324, 307, 386, 504, 506 and 34 of the Indian Penal Code. Learned counsel for petitioner submits that there is case and counter case between the parties. The wife of petitioner, namely, Neeta Kumari lodged SC/ST P.S. case no. 30 of 2018 alleging that informant of the present case and other accused persons assaulted the petitioner on 24.5.2018 for not paying Rs. 50,000/- as ransom to them and again on 26.5.2018 informant and other accused persons entered in the house and Anganbari center of Neeta Kumari and started abusing her and resorted to brick and stone pelting due to which Aryan Kumar and her son Sudhanshu Kumar got injured.
In the instant case it is alleged that on the date of occurrence while the informant was cleaning the shop at 9.15 AM
Patna High Court CR. MISC. No.39923 of 2019(2) dt.04-07-2019 2/2 Chottu Kumar and Bicku Razak abused him for opening the shop and when informant made protest they assaulted him and his nephew Aryan Kumar. Aryan Kumar was assaulted by brick and he got injury on his head and his right hand got fractured. The injury report of Aryan Kumar has been annexed as Annexure-4 which is of the private hospital. It shows that some medicine were given to victim.
Petitioner is in custody since 19.3.2019 having no criminal antecedent.
The learned counsel for informant has appeared and opposed the prayer for bail.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM, Barh, Patna in connection with Mokama P. S. Case No. 135 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner (Sanjay Priya, J) shyambihari/- U T
