JUSTICE SUDHIR SINGH ORAL ORDER 28-09-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is apprehending his arrest in connection with Bhabua P.S. Case No. 49 of 2015 for the offences instituted under Sections 147, 149, 448, 504, 323, 354(B), 307, 379, 506 of the IPC.

The prosecution story, in brief, is that the accused persons with hockey stick in their hands entered into the house of the informant and started abusing her son who was talking in a room with his friend and assaulted him causing head injury and also outraged the modesty of the informant and also committed theft.

It has been submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.39461 of 2015 (2) dt.28-09-2015 2/2 petitioner has falsely been implicated in the present case. It is a case and counter case. From perusal of Annexure-3 which is the injury report it would appear that the injuries are simple in nature. The alleged occurrence is said to have taken place due to political reason. Other co-accused have been granted bail by this Court vide Annexure -3 series.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Bhabua P.S. Case No. 49/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kaimur (Bhabua), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
