JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-08-2017 Heard the learned counsel for the petitioner Shri Anil Kumar and the learned counsel Shri Lokesh Kumar Singh for the State.

The petitioner seeks regular bail in connection with Rajepur P.S. Case No. 77 of 2017, for the offences punishable under sections 379 and 411 of the Indian Penal Code. The case of the prosecution is that the petitioner herein and other accused were arrested while stealing 11 KV HT electric wire thus causing loss to the State exchequer to tune of Rs. 32,476/-.

The learned counsel for the petitioner submits that the petitioner has a clean antecedent and has been falsely roped in the present matter. However, learned counsel submits that petitioner

Patna High Court Cr.Misc. No.37745 of 2017 (2) dt.10-08-2017 is ready to deposit a sum of Rs. 5,000/- being approximately 1/7 of the loss amount before the learned trial court. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on bail upon depositing a sum of Rs. 5,000/- before the learned Trial Court and furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sadar, District-East Champaran at Motihari in connection with Rajepur P.S. Case No. 77 of 2017. It is made clear that the aforesaid sum of Rs. 5,000/- would remain deposited before the learned trial court subject to the final outcome of the trial.
