The petitioner seeks bail in Araria (RS) P.S. case No. 651 of 2016 under Section 394/384 of the Indian Penal Code. The informant alleged that while he and others were going to Forbesganj on a pick-up vehicle, petitioner and others got stopped the vehicle and made attempt to loot the informant and others.

The learned counsel for the petitioner submits that on the same and similar facts Md. Adnan Ahmad and Md. Afjal @ Abjal have already been granted bail vide order dated 21.12.2016 passed in Cr. Misc. No. 54146 of 2016. The case of the petitioner stands on the same footing. Although one driving license was recovered from the possession of the petitioner but petitioner is in

Patna High Court Cr.Misc. No.55356 of 2016 (4) dt.17-03-2017 2/2 jail custody since 26.09.2016. The petitioner has already remained in jail for about six months.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in Araria (RS) P.S. Case No. 651 of 2016.
