1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Mahila P.S. Case no. 23 of 2025 registered under sections 115(2), 126(2), 351(2), 85, 3(5) and 79 of the Bharatiya Nyaya Sanhita, 2023 and sections 3/4 of the Dowry Prohibition Act.
3. As per the prosecution case, the informant was married to the petitioner in the year 2021. It is stated by the informant that after some time of the marriage, she lost her job in NMCH where she was engaged on contract basis. As a result, the petitioner started to torture her over payment of the EMI for their car. The informant further states that she was abused,
Patna High Court CR. MISC. No.40982 of 2025(3) dt.08-10-2025 2/3 assaulted and the petitioner used to threaten her of throwing away the child/daughter from the balcony of the residence.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. The allegation of abuse and assault are all false and concocted. It is submitted that from the contents of the FIR itself, it would transpire that the informant was engaged as a lab technician on contract basis in NMCH, Patna. The petitioner has no criminal antecedent and undertakes to cooperate in the investigation/trial.
5. The application for anticipatory bail is opposed by learned A.P.P. for the State and learned counsel for the informant. Learned counsel for the informant submits that there is direct allegation of abuse and assault by the petitioner who happens to be her husband. It is further submitted that it is a case of repeated assault by the petitioner. Further the informant has also filed a maintenance case being Maintenance Case no. 96 of 2025 which is pending in the Court of Principal Judge, Family Court, Patna, wherein the petitioner is avoiding appearance.
6. Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner in the F.I.R. together with the petitioner not having any criminal

No.40982 of 2025(3) dt.08-10-2025 3/3 antecedent, in the facts of the case, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Mahila P.S. Case no. 23 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna.
7. It is directed that the petitioner shall appear in Maintenance Case no. 96 of 2025 pending in the Court of Principal Judge, Family Court, Patna within a period of four weeks from today.
