The petitioner seeks bail in a case registered under Section 392 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act.

It is contended on behalf of the petitioner that he is the father of the co-accused, Shamshad, whose name has cropped up on the basis of confessional statement of the co-accused persons that the aforesaid Shamshad had put Rs.17,000/- under the pillow in the house, which belongs to the petitioner. It is contended that wife of the petitioner was Mukhiya from the year 2006-11 but in view of the fact that his son had kept the looted money in his room, which has been recovered on the basis of the confessional

Patna High Court Cr.Misc. No.42677 of 2016 (2) dt.04-10-2016 2 / 2 statement of co-accused, Shamshad, the petitioner, being the father, has also been booked up. It is further contended that the petitioner has remained in custody since 02.08.2016. Petitioner claims that his antecedent is clean.

Having regard to the facts and the circumstances of the case, the above named petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No.430/2016 with a condition that one of the bailors of the petitioner must be the close relative or his family member, who will file affidavit before the court below giving full genealogy showing his or her relationship with the petitioner.
