2. The petitioner seeks regular bail in connection with Muzaffarpur Mahila P.S. Case No. 34 of 2020 registered for the offence under Sections 341, 342, 448, 506, 504, 323, 376/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is accused of committing rape with the victim.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 19.04.2025.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Though the petitioner is accused of committing

Patna High Court CR. MISC. No.39534 of 2025(4) dt.15-09-2025 2/2 rape with the victim but from the perusal of the FIR, it appears that it is a case of consensual sex between two adults.

7. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Muzaffarpur, East/concerned Court below in connection with Muzaffarpur Mahila P.S. Case No. 34 of 2020.
