Petitioner is in custody in connection with Kankarbagh P.S. Case No. 261 of 2019 for the offence under sections 27b(II), 28, 28/A of Drugs and Cosmetics Act, 1940. Learned counsel for the petitioner submits that on the same day two cases were were registered against the petitioner. Referring to the prosecution case, learned counsel for the petitioner submits petitioner is subjected as seller of oxytocin and other chemicals which is ban.

Learned counsel for the petitioner submits that except confessional statement of the co-accused there is no material against this petitioner.

Considering the fact that nothing was recovered from the possession of the petitioner and his name surfaced on the confessional statement of the co-accused, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Smt. Madhavi Singh, J.M.-1st Class, Patna, in connection with Kankarbagh P.S. Case No. 261 of 2019.
