Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-363, 366(A), 506/34 of the Indian Penal Code. Petitioner happens to be brother of the FIR named accused, Akchhay Kumar Singh. One of the victims, specifically, stated in her statement, recorded under Section-164 of the Cr.P.C. that being major, she has solemnized her marriage with coaccused, Akchhay Kumar Singh and as a matter of fact, she was never kidnapped. Similarly, the second victim namely, Priya Kumari also stated that she was never kidnapped rather she along with her sister had gone to Purnea.
