2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 304(B), 302, 201, 120(B)/34 of the Indian Penal Code.
3. It is a case of dowry death of daughter of the informant due to non-fulfillment of dowry demand. The petitioner is husband of the deceased who was married to her in the year of 2021.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is husband of the deceased due to which he has falsely been implicated in this case. There is no prior complaint against the petitioner regarding demand of dowry or torturing the
Patna High Court CR. MISC. No.45023 of 2024(2) dt.02-07-2024 2/2 deceased. The petitioner has got no criminal antecedent and languishing in judicial custody since 15.2.2023. It is further submitted that the deposition of the informant has been done during trial which is annexed as Annexure-II, by which it appears that the informant has not supported the case and narrated different story. The charge has already been framed against the petitioner.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Doriganj P.S. Case No. 269 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-IV, Saran at Chapra.
