JUSTICE SANJAY PRIYA ORAL ORDER 11-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Banmankhi P.S. Case No. 68 of 2016 instituted for the offence under Section 392 of the Indian Penal Code.

As per written report, Mobile and Motorcycle of the informant were snatched by two unknown persons at the point of pistol (Katta).

The learned Sessions Judge has mentioned in the impugned order that on the basis of confessional statement of this petitioner made in paragraph-72 of the case diary, the alleged theft Motorcycle has been recovered.

Learned counsel for the petitioner has mentioned in paragraph-10 of the bail petition that no recovery has been made on the basis of alleged confession.

Patna High Court Cr.Misc. No.21161 of 2017 (3) dt.11-07-2017 2/2 In the instant case only one Mobile phone has been recovered from possession of the petitioner. The petitioner is said to be in custody since 12.2.2017.

Considering the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner named above, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Purnea, in connection with Banmankhi P.S. Case No. 68 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
