Petitioner seeks bail in Chandauti P.S. Case No. 34 of 2018 registered for the offence punishable under Sections 399 and 402 of the Indian Penal Code and Section 3/4/5 of Explosive Substances Act.

Allegation against the petitioner is attempt of committing dacoity in the house of the informant. It has been submitted on behalf of the petitioner that the petitioner was not caught on the spot and nothing has been recovered from the possession of the petitioner. He has been implicated in this case on confession of co-accused. Similarly, situated co-accused person has been granted bail by a co-ordinate bench of this Court vide order dated 20.08.2018 in Criminal Miscellaneous No. 34014 of 2018. Petitioner is in

Patna High Court Cr.Misc. No.41888 of 2018(3) dt.06-09-2018 2/2 custody since 17.03.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Chandauti P.S. Case No. 34 of 2018.
