JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 392, 411 of the Indian Penal Code.

Petitioner is not named in the first information report but in course of investigation, the name of petitioner came in this case and it is alleged that two looted motorcycles were recovered from his house but submission on behalf of the petitioner is that the recovered motorcycles are not the looted motorcycle of the present case and moreover, for recovery of aforesaid motorcycles, a separate case i.e. Kalyanpur P.S. Case No. 48 of 2016 was

Patna High Court Cr.Misc. No.38818 of 2016 (3) dt.15-11-2016 2/2 registered and petitioner has already been granted privilege of bail in Kalyanpur P.S. Case No. 48 of 2016.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Samastipur in connection with Kalyanpur P.S. Case No. 28 of 2016.
