SMT PUSHPA SINHA ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 07-02-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Dhangi P.S. Case No. 23 of 2016 instituted for the offence under Sections 302, 201, 34 of the Indian Penal Code.

Earlier the bail application of the petitioner was rejected vide Annexure-3 to the present application taking into account that the onus was on the petitioner to explain the cause of death of his wife.

A report was called for from the Court below regarding the stage of the case. It has been reported that within three months the trial is expected to be concluded.

Considering the same, I am not inclined to grant bail to the petitioner. Prayer is rejected. The Trial Court is directed to take

Patna High Court Cr.Misc. No.44904 of 2017(3) dt.07-02-2018 2/2 all necessary steps to conclude the trial within a period of three months preferably on day-to day basis from the date of receipt/production of a copy of this order.

The District Magistrate, Ara and and Senior Superintendent of Police, Ara are also directed to take necessary steps to produce the witnesses on the date fixed in the Trial Court so that the trial could be concluded within the stipulated period.
