NILU AGRAWAL ORAL ORDER 07-10-2015 Heard learned counsel for the petitioner Mr. Ranjeet Kumar Singh and learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Chautham P.S. Case No. 62 of 2015 registered for offences punishable under Sections 406/409/420 of the Indian Penal Code. The prosecution case is that the petitioner being the Head Master of the Primary School at Srinagar defalcated government money of Rs. 2,41,043/- which was allotted to the school for construction of kitchen shed for the year 2012-13. It has been submitted by the counsel for the petitioner that the petitioner has clean antecedent which finds place at paragraph No. 3 of this application. He submits that the petitioner is innocent and has falsely been implicated in the aforesaid case for the offence alleged to have been committed in the year 2012-13.

No.41620 of 2015 (2) dt.07-10-2015 P2/2 It has further been submitted by counsel for the petitioner that the petitioner had withdrawn a sum of Rs. 1, 60,000/- on 11.05.2013 and rest amount had been deposited in the account of the School itself and all the details of the expenses and the deposits had been handed over to the next Head Master, namely, Sanjay Kumar before he was transferred to another school. It has furthermore been submitted that the allegations are baseless. He has already been transferred to Meghauna Primary School on 23.12.2013.

Be that as it may, let the petitioner abovenamed, in the event of his arrest / surrender within a period of four weeks from today, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Khagaria in connection with Chautham P.S. Case No. 62 of 2015 (G.R. No. 1199/2015) subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
