2. The petitioners seek bail in a case registered for the offence punishable under Sections-341, 323, 324, 307, 354, 379, 504, 506, 34 of the Indian Penal Code.

3. Allegedly, the petitioner No. 1 hurled Bhala blow at the chest of informant's uncle, due to which, he sustained injury. Further allegation is that other accused persons including the petitioner No. 2 assaulted the informant by means of Bhala and butt of fire-arm.

4. It has been submitted on behalf of the petitioners that the petitioners are innocent and they have falsely been

Patna High Court CR. MISC. No.44748 of 2024(2) dt.02-07-2024 2/2 implicated in the present case. It has further been submitted that the injuries are simple in nature. Both parties are agnates. There is case and counter case between the parties. The petitioners are in custody since 26-04-2024.

5. Learned APP has opposed the prayer for bail.

Considering the aforesaid facts and circumstances, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Naugachia, Bhagalpur in connection with Naugachia P.S. Case No. 140 of 2024 with condition that the petitioners shall cooperate with the trial and make themselves available as and when required by the court.
