The petitioner, namely, Sri Kant Yadav @ Sri Kant Kumar Yadav who apprehends his arrest in Barari P.S. Case No.185 of 2014 under Sections 147, 148, 149, 341, 323, 324, 448, 427, 326, 379, 307, 506 of the Indian Penal Code and Section 27 of the Arms Act.
The learned counsel for the petitioner submitted that there is land dispute between the parties, as a result of which, there are cases and counter cases. There are about 16 accused persons and out of them, 12 accused persons in similarly situated case have already been granted anticipatory bail. The case of this petitioner stands on the same footing. Therefore, the learned
Patna High Court Cr.Misc. No.41643 of 2015 (2) dt.13-10-2015 counsel submitted that the petitioner be also granted anticipatory bail. According to him, there is no allegation of assault or overt act alleged against the petitioner.
From perusal of the order dated 24.06.2015 passed in Cr. Misc. No.21924 of 2015 and 22204 of 2015, it appears that many of the co-accused persons, whose cases stand on similar footing, have been granted anticipatory bail by this Court. It appears that the case of this petitioner is on same footing. Considering the above facts, I direct the petitioner named above to surrender before the court below within six weeks from today and on his so surrendering, the court below is directed to release the petitioner on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Barari(Semapur) P.S. Case No.185 of 2014.
