1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Pasraha P.S. Case No. 101 / 2025 dated 18.04.2025 registered under Sections 108 of the B.N.S. Act.

3. As per the F.I.R. the petitioner has abetted the informant's daughter to commit suicide.

4. Learned counsel for the petitioner submits that petitioner was studying in Ploytechnic College, Mahidpur, DistrictKhagaria and the deceased was also a student of Third Year of this College. She was living in room no. 9 of the girls' hostel. Both of them developed friendship and used to talk with each other on mobile phone. On 28.02.2025 after the death of the informant's daughter the informant has lodged a U.D. Case bearing Pasraha U.D. Case No. 1 / 2025 however after lapse of

No.39910 of 2025(5) dt.15-10-2025 2/3 more than one month the F.I.R. has been lodged stating that the petitioner and the informant's daughter were having love relationship and the deceased started relying upon the petitioner. On the date of occurrence some verbal dispute took place between the petitioner and the informant's daughter thereafter she committed suicide. He next submits that during the course of investigation suicide note was found along with mobile phone with the help of which the petitioner and the victim used to talk. In the suicide note there is no indication that the petitioner persuaded and / or instigated the deceased to commit suicide.

On the other hand, learned counsel for the informant vehemently opposed the prayer for anticipatory bail and submits that the call details of the mobile of the petitioner as well as the victim girl goes to show that they were having regular conversation with each other and on the date of occurrence also the deceased and the petitioner had call duration of about 110 minutes. The suicide note and the call log of the petitioner and the deceased go to show that the petitioner is responsible for the suicide of the victim girl.

6. Regard being had to the submission made by the parties and taking into consideration the material on record it appears

Patna High Court CR. MISC. No.39910 of 2025(5) dt.15-10-2025 3/3 that there is no prima facie material to show that petitioner persuaded actively and / or instigated the victim to commit suicide, accordingly, I am inclined to grant anticipatory bail to the petitioner.

Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Khagaria / concerned court in connection with Pasraha P.S. Case No. 101 / 2025 subject to the condition as laid down under Section 482 (2) of the B.N.S.S. 2023.
